1. DefinitionsIn these terms and conditions the following words shall have the meanings set out below:
“
Confirmation” means the confirmation email sent to you by the Company under clause 4.1.3 acknowledging your booking and setting out the details of your booking.
“
Contract” means any contract for the purchase of Tickets made between you and the Company.
“
Company” means Morpheus Games UK Limited whose registered and principal trading address is 71-75 Shelton Street, London, United Kingdom, WC2H 9JQ. Registered in England company number 11868570.
“
Online Booking Form” means the series of pages for the booking of Tickets set out on the Company’s website.
“
Third Party” means a party other than you and the Company.
“
Ticket” means any ticket for attending online interactive audio show (hereinafter “Performance”) offered for sale by the Company or its authorised agents consisting of a zoom link to the Performane. All tickets shall be supplied by email in electronic form.
2. General2.1. These terms and conditions relate to the purchase and supply of Tickets and your participation in Performance. Please read these terms and conditions carefully before purchasing any Tickets as by doing so, you accept that these terms and conditions will govern all Contracts.
2.2. Nothing in these terms and conditions is intended to affect your statutory rights.
3. Purchasing Tickets3.1. If you book Tickets on behalf of others, you accept these terms and conditions on behalf of all members of the group and are responsible for all payments due from the party.
3.2. Only persons who are at least 18 years of age are permitted to book Tickets. By booking Tickets you warrant to the Company that you comply with this requirement. Additional requirements may be placed on participation in Performances. Please carefully learn such requirements before purchasing Ticket. The Company reserves the right to refuse in your admission to the Performance if you are failed to meet any and all such additional requirements.
3.3. If there are any changes to your details once your booking has been concluded then it is your responsibility to inform the Company. You can manage your booking by sending relevant e-mail to
info@morpheus-show.co.uk.
3.4. The Company reserves the right to terminate Ticket sales for a performance at such time as it shall think fit (or as directed by any relevant Third Party).
3.5. It is your responsibility to check that any Tickets issued to you are accurate.
3.6. Any purchase of Tickets is only valid when processed by the Company or an agent authorised by the Company.
3.7. If you wish to transfer your Tickets into someone else’s name, you must contact the Company by either email or telephone at least thirty six hours before the start of the performance and provide the name, phone number and email address of the person who will be attending.
3.8. Except as permitted by clauses 3.7, your Tickets may not be transferred or resold for commercial purposes or at a premium. If a Ticket is transferred or resold in breach of this condition, the bearer of the Ticket or the person claiming the right to attend the event will be refused admission to the performance or event and any membership(s) you may have with the Company will be terminated.
3.9. The Company (or the relevant Third Party) shall be entitled to make changes as to speakers, performers, running times and such other matters as it thinks fit in the case of any event.
3.10. By purchasing a Ticket, you shall be deemed to consent to your and any members of your group participation in performance being filmed where the performance is being filmed and that the Company has complete discretion as to use of any film without any recourse to you or any member of your group for quality control and staff/actors training purposes.
3.11. All purchases of Tickets are final and non-refundable unless otherwise explicitly provided by applicable law.
4. Conclusion of Contract and Ticket delivery4.1. Your Contract with the Company will be concluded as follows:
4.1.1. completion and submission of the Online Booking Form shall constitute an offer by you to purchase Tickets subject to these terms and conditions. You can correct any mistakes you make when filling out the Online Booking Form at any point before submitting it;
4.1.2. once you submit the Online Booking Form, the Company will check that you have completed all parts of the Online Booking Form and send you a payment link. This in itself does not constitute acceptance of your offer;
4.1.2.1. if necessary, the Company prior to sending payment link may communicate to you in order to clarify details of your booking, e.g. if you want to order non-ordinary performance for bigger group of participants or if you want to personalize the performance;
4.1.3. you shall press the payment link and compete all relevant stages of payment available through the payment link until you see on-screen payment confirmation;
4.1.4. once payment has been taken, an on-screen confirmation will be displayed and the Company will send you a Confirmation through e-mail as soon as possible. This Confirmation shall constitute the Company’s acceptance of your booking. A Contract will be formed once you have received the Confirmation; and
4.2. The only language available for the conclusion of a Contract online is English.
4.3. Details of all Contracts concluded online (including the method of payment but not the card details) will be kept on file by us and can be provided to you upon request.
4.4. You are entirely responsible for entering all details correctly on the Online Booking Form and any additional information requested. By submitting an Online Booking Form or any other form you warrant to the Company that all details supplied by you are true and accurate.
4.5. Along with the Confirmation the Company sends to your e-mail containing an entrance link to the zoom conference where Performance will take place.
5. Price and Payment5.1. The price (including all taxes where relevant) of all Tickets is specified on the Website. These details are based on the best available information to the Company and the Company is not obliged to conclude any Contract on these terms.
5.2. The Company accepts payment by MasterCard, Visa cards or through other means available through Company`s payment service provider.
5.3. If you wish to make a payment using a third party credit/debit card you must provide the Company with written authorisation from the card holder.
6. Refund and Exchange Policy for Tickets 6.1. Subject to clauses 6.2., the Company will not refund your Tickets after purchase.
6.2. Where the Company is unable to perform a Contract on the date(s) agreed because the performance in question is no longer available or viable, or is abandoned when less than half the performance has taken place, the Company will offer you Ticket to another Performance the same or higher price. You are entitled to choose must appropriate Performance Tickets to which are proposed to you.
6.3. You are entitled to exchange your Ticket to the Ticket to another Performance with the same Price provided that you send the relevant request to the e-mail address
info@morpheus-show.co.uk at least 36 hours prior to the Performance start.
7. AlterationsAll Tickets are sold subject to the Company’s right to make any alterations in the cast or programme details advertised on the Website.
8. Terms and Conditions of the Performance8.1. Performances are conducted through zoom conference access link to which is provided to your e-mail along with the Confirmation. Each person participating in the Performance shall purchase a Ticket, even if such persons access the Performance via sole device. The Company prohibits to participate in the Performance for more than 2 (two) persons using the same device, provided that each of such person purchased a separate Ticket to the Performance.
8.2. You are entitled to enter into Performance conference room 5 minutes before the start of the Performance but in any case, not later than 5 minutes after the start of the Performance. The Company reserves the right to reject your admission to the Performance if you try to enter into the Performance conference room after 5 minutes after the start of the Performance.
8.3. You shall wear blindfold to gain the best experience during the Performance.
8.4. You shall behave civil and politely to other participants of the Performance, actors and other staff. The Company reserves the right to block your access to the Performance if your behavior is inappropriate for other participants or encumber in any way of further Performance.
8.5. You are solely responsible for providing, maintaining and ensuring the compatibility of all hardware, software, electrical and other physical requirements necessary for your access and participation in the Performance or any part thereof.
You are responsible for all internet access charges incurred in connection with your participation in Performance. Please check with your internet service provider for information on possible internet data usage charges. Please note that your participation in the Performance may count toward your data usage, depending on the terms of your agreement with your internet service provider.
Company makes no representations or warranties about the quality of your viewing or audio experience on any or all of your devices. The quality of the audio and display of Performance may vary from device to device.
8.6. If you lost connection to the Performance conference room, please contact us at the e-mail address
info@morpheus-show.co.uk in order to restore your access to the Performance conference room, provided however that the Company shall not obliged to refund you the cost of Ticket if you will still not able to re-enter the Performance conference room.
9. Liabilities of the Company9.1. Subject to clause 9.3 below, the Company will only be liable to you for direct and foreseeable losses arising as a result of:
9.1.1. a breach of these terms and conditions by the Company; or
9.1.2. any negligent act of the Company arising under or in connection with the Contract.
9.2. The Company’s total liability under clause 9.1 above shall be limited to the total face value of the Tickets.
9.3. The Company will not be liable in any way if it is prevented from performing its obligations under or arising from any Contract due to any circumstances which are beyond its reasonable control. Without limiting the foregoing, the following shall be regarded as circumstances beyond its reasonable control:
9.3.1. acts of god, which include earthquakes, cyclones, storms, flooding, fire, disease, pandemic, fog, snow or frost;
9.3.2. force majeure which includes war, accidents, acts of public enemies, strikes, embargoes, perils of the air, local disputes, terrorist or other attacks and civil commotions;
9.3.3. power failure and failure of sound or lighting equipment.
